DNA

On January 1, 2009, the new law expanding Maryland’s Statewide DNA Database goes into effect, requiring qualifying individuals to submit a DNA sample upon charging for qualifying offenses. Qualifying offenses include crimes of violence as defined in Maryland Code, Criminal Law Article, 14-101(a), burglary in the 1st, 2nd, and 3rd degree and any attempts of these crimes. DNA samples will be collected at the time of charging during the booking process when photographs and fingerprints are taken. DNA samples will be sent to the Maryland State Police Forensic Sciences Division (MSP-FSD) for processing and analysis will occur on the first scheduled arraignment date of the suspect. Maryland law provides for automatic expungement of qualifying DNA samples and records. MSP-FSD will handle all expungement and destruction procedures for samples that qualify for automatic expungement.

MARYLAND STATE POLICE WEBSITE LINK:
Law enforcement agencies may access an electronic version of the DNA Database Information Card found within the Maryland State Police DNA collection kits. This form can be populated with data and printed out for submission within the kit.
